同一号内ニ於ケル二人以上ノ債権者ハ同一ノ割合ヲ以テ弁償ヲ受ク但第十二号ノ場合ハ此限ニ在ラス
登記セサル債権ニ付キ船舶又ハ運送賃ノ負担スル責任ハ任意ノ譲渡ノ場合ニ在テハ船舶カ譲渡人ノ債権者ノ異議ヲ受クルコト無ク取得者ノ名義及ヒ計算ニテ船籍港ヨリ新ニ航海ヲ為シ且其発航以来少ナクトモ六十日ヲ経過シタル後消滅ス
The ship, together with appurtenances and outstanding freight, even though in the possession of third persons, is liable in respect of the following rights of claim in the order specified :—
i. Judicial costs and other charges incurred in the compulsory sale of the ship and in the distribution of the price realized, as well as the expenses of watching and maintaining the ship and appurtenances from the commencement of the compulsory sale procedure ;
ii. Shipping dues, such as port dues, tonnage dues, light dues and others ;
iii. Expenses of maintaining the ship and appurtenances from the time of her entrance into port, as well as pilotage and towage ;
iv. General average, and expenses for rescue, salvage, and other assistance rendered during the last voyage ;
v. The rights of claim of the master and members of the crew under their contracts of service for the last term thereof ;
vi. The rights of claim in respect of Ioans contracted by the master during the last voyage for the requirements of the ship, and the right of recourse in respect of cargo sold by him for the same purpose during the same, as well as in respect of the price of things or services likewise supplied or rendered to him ;
vii. The rights of claim in respect of the sale, building, and equipment of the ship, inclusive of workmen's wages, if the ship has not yet gone upon a voyage ; and the rights of claim for repairing, equipment, and provisioning for the last voyage, before the ship has entered thereon ;
viii. The rights of claim in respect of loans for purposes of the building or equipment of the ship, or in respect of payments on account of purchase-money by the party on whose account the ship is built, so long as the seip has not been handed over to him ;
ix. The rights of claim in respect of premiums of insurance effected on the ship and appurtenances for her last voyage or last term of premium payment ;
x. The rights of claim in respect of nondelivery of cargo or passengers' luggage, or in respect of any damage the same may have sustained, through the fault of master or crew ;
xi. The rights of claim for damages arising by reason of collision between ships or other fault of the master or crew ;
xii. Such rights of claim as are entered in the shipping register, in the order of the date in which they have been entered ;
xiii. All other rights of claim against the owner or vendor of the ship.
The creditors that come under the same class, with exception of those coming under the class xii, are to be satisfied rateably.
The liability of ship and freight for non-registered rights of claim is extinguished, in the event of voluntary alienation, as soon as the ship has gone on a fresh voyage from the port of registry in the name and on the account of the new owner, without any objection on the part of the creditors of the alienor, and sixty days at least have elapsed since her departure.

The privileged debts which in the case adverted to in the preceding article can be recovered out of the proceeds of sea-going ships, are the undermentioned. — They are privileged in the following order:
1. The Salvage, assistance, and pilot dues;
2. The buoy, beacon, lighthouse, and quarantine dues, and other port-charges;
3. The guards', keepers', and porters' wages;
4. The rent of warehouses or stores to deposit the ship's rigging, inventory and implements;
5. The wages of the master and crew;
6. The providing or furnishing of sails, cordage, and other ships-necessaries, and the expenses of maintenance and repairs of the ship and its appurtenances.
The money advanced or lent to the captain or paid for him for the benefit and use of the ship; as also the amount due as indemnity for goods which he has had to sell in order to discharge such debts, and — in case money has been taken upon bottomry for the whole or part of the same, — the bottomry-bond with addition of the premium thereon.
The debts, above mentioned under Nos. 1, 2, 5 and 6, enjoy the privilege, if contracted on account of the last voyage, namely:
Those mentioned under Nos. 1 and 2, and in the last paragraph of No. 6, as far as they have been contracted during the voyage.
Those designated under No. 5 and in the first paragraph of No. 6, for as much as they have been contracted from the time of fitting out the ship for the voyage, till the time at which the voyage is held to have ended.
The voyage is held to have ended, one and twenty days after the ship has arrived at her destination, or as much sooner as the last goods have been unloaded.
The debts, mentioned under Nos. 3 and 4, enjoy the privileges for as much as they have been incurred from the day on which the ship entered the port, until that of its sale.
7. The necessary deliveries and repairs to the ship and her materials not pertaining to those above mentioned under No. 6, during the last three years from the day on which the repairs were completed.
8. She Claims for the building the ship, with interest for the last three years.
9. Bottomry on the ship, her standing and running rigging, and appurtenances, taken for the victualling and equipping thereof, contracted and signed for before its departure; — the bottomry-premium not included.
10. The damages, costs, and interest claimed by shippers for short or improper delivery of goods shipped by them, and those caused by neglecting duty of the master or crew.
The privilege, granted by the preceding articles, is lost, if the ship, after having been transferred to another without protest of privileged creditors, has navigated on the name and for account of the new owner, during sixty days after leaving port.
Such protest benefits only the creditor in whose name it has been made.
These stipulations do not apply to the sale in a foreign country mentioned in the 310th article, in which case the liabilities, privileges, and rights, remain in force.
§. 901. Die im §. 754 Nr. 1 bis 9 aufgeführten Forderungen verjähren in einem Jahre. Es beträgt jedoch die Verjährungsfrist zwei Jahre:
1. für die aus den Dienst- und Heuerverträgen herrührenden Forderungen der Schiffsbesatzung, wenn die Entlassung jenseits des Vorgebirges der guten Hoffnung oder des Kap Horn erfolgt ist;
2. für die aus dem Zusammenstoße von Schiffen hergeleiteten Entschädigungsforderungen.
Den Landesgesetzen bleibt vorbehalten, zu bestimmen, daß auch in anderen Veräußerungsfällen die Pfandrechte erlöschen, wenn die Schiffsgläubiger zur Anmeldung der Pfandrechte ohne Erfolg öffentlich aufgefordert sind, oder wenn die Schiffsgläubiger ihre Pfandrechte innerhalb einer bestimmten Frist, seitdem das Schiff in dem Heimathshafen oder in einem inländischen Hafen sich befunden hat, bei der zuständigen Behörde nicht angemeldet haben.
Die im Artikel 757. aufgeführten Forderungen verjähren in einem Jahre. Es beträgt jedoch die Verjährungsfrist zwei Jahre:

Indépendamment des moyens généraux d'extinction des obligations, les privilèges des créanciers sur le navire s'éteignent, savoir:
1° Par une vente en justice à la requête des créanciers ou à la suite d'un événement quelconque lorsque la vente a lieu conformément aux règles tracées au livre IV et après le paiement du prix sur lequel les privilèges sont transférés;
2° Par l'expiration du délai de trois mois dans le cas d'aliénation volontaire.
Ce délai court à partir de la date de la transcription de l'acte d'aliénation si le navire se trouve, au temps de la transcription, dans le département où il est inscrit; le délai court à partir du retour du navire dans le dit département si la transcription de l'aliénation a été faite le navire étant déjà parti, et c'est à la condition que la vente soit notifiée aux créanciers privilégiés dont les titres se trouvent transcrits et annotés sur l'acte de nationalité.
L'extinction est suspendue par rapport au créancier privilégié qui, avant l'expiration du délai, a actionné en justice l'acquéreur pour obtenir la déclaration de son privilège.
- Lorsque l'acte constatant la vente aux enchères publiques aura été dressé et inscrit sur le registre du commerce, toutes les autres responsabilités du navire au profit des créanciers seront réputées éteintes.
Toutefois, si la vente a été faite volontairement et alors que le navire se trouvait en cours de route, les créanciers conserveront leurs droits contre le navire jusqu'à ce qu'il revienne au port de sa matricule et jusqu'a l'expiration d'un délai de trois mois a partir de l'inscription de la vente sur le registre, ou du retour du navire.
Les privilèges des créanciers sur le navire s'éteignent:
1° Par les modes généraux d'extinction des obligations:
2° Par la vente en justice du navire; après que le prix en est mis en dépôt, le privilège et l'action des créanciers sont transportés sur le prix;
3° Par la vente volontaire faite avec dénonciation aux créanciers privilégiés, sans que, dans un délai de trois mois, ils aient fait valoir leur privilège ou fait opposition sur le prix de la vente.
Les privilèges des créanciers seront éteints, indépendamment des moyens généraux d'extinction des obligations :
Par la vente en justice faite dans les formes établies par la loi;
Ou par la vente volontaire transcrite conformément à l'article 2, publiée dans un des journaux d'Anvers, de Gand et dans ceux du port d'armement et affichée au mat ou à la partie la plus apparente du navire, sans opposition de la part des créanciers du vendeur, notifiée dans le mois de la publication et de l'affiche tant au vendeur qu'à l'acheteur.
Néanmoins les droits de préférence des créanciers subsistent sur le prix, tant que celui-ci n'a pas été payé ou distribué.
