手形又ハ小切手ノ占有者ニシテ正当ノ方法ニ依リ且甚シキ怠慢ニ出テスシテ之ヲ取得シタル者ハ其手形又ハ小切手若クハ其代金ノ引渡ノ請求ニ応スル義務ナシ但占有者カ手形又ハ小切手ノ引渡ヲ求ムル訴ヲ起シタル場合アルニ当リ之ニ対シ抗弁ヲ為シ得ヘキ事実ト同一ノ事実ニ因リテ請求セラルルトキハ此限ニ在ラス
