仲立人カ其媒介スル行為ニ付キ見本ヲ受取リタルトキハ其行為カ完了スルマテ之ヲ保管スルコトヲ要ス

In transactions negotiated by brokers in respect of goods, they are personally to convince themselves of the existence and quality of the goods and of the solvency of the purchaser, and to preserve, properly marked, the patterns and samples delivered to them, until the transaction is completely finished.
If not released therefrom by the parties, brokers are bound to keep the sample on which goods have been sold by their intervention, until after the complete delivery of the same, marking it properly for identification.
Der Handelsmäkler muß, sofern nicht die Parteien ihm dieses erlassen haben oder der Ortsgebrauch mit Rücksicht auf die Gattung der Waare davon entbindet, von jeder durch seine Vermittelung nach Probe verkauften Waare die Probe, nachdem er dieselbe behufs der Wiedererkennung gezeichnet hat, so lange aufbewahren, bis die Waare ohne Einwendung gegen ihre Beschaffenheit angenommen, oder das Geschäft in anderer Weise erledigt ist.

Le courtier, lorsqu'il n'en est pas exempté par les parties, ou en raison de la nature de la marchandise par les usages locaux, est tenu, lors de tout marché conclu sur échantillon par son entremise, de conserver cet échantillon après l'avoir marqué pour le reconnaître, tant que la marchandise n'aura pas été reçue sans réclamation sur sa qualité, ou que l'affaire n'aura pas été exécutée de toute autre manière.
Outre la responsabilité que les courtiers encourent en cette qualité, pour manquement aux obligations qui leur sont imposées par les articles 68 et 76. ils seront encore soumis à celle qui découle des contrats de mandat et de commission, en tant qu'elle est applicable aux négociations dans lesquelles ils interviendront; et, d'un autre côté, ils auront contre leurs commettants les droits qui résultent pour eux desdits contrats.
