保険ハ自己ノ計算ヲ以テスルト他人ノ計算ヲ以テスルトヲ問ハス又被保険者ノ委託ヲ受ケタルト否ト被保険者ノ予知スルト否ト被保険者ヲ明示スルト否トヲ問ハス之ヲ受クルコトヲ得

契約ニ依リテ他人ノ利益カ知レサルトキハ保険申込人ハ保険者ニ対シテ被保険者ト看做サル

保険契約ハ保険者又ハ契約取結ノ権アル代人カ保険申込書及ヒ之ニ属スル陳述書ヲ異議ナク承諾シタルトキハ之ヲ取結ヒタリト看做ス

Wenn ein Versicherungsnehmer einen Versicherungsvertrag zu Gunsten eines Anderen schließt, ohne dazu beauftragt zu sein, und diese Tatsache dem Versicherer nicht mitteilt, so ist der Vertrag nichtig. Hat er ihm Mitteilung gemacht, so wird der Versicherte ohne weiteres der Vorteile des Vertrages teilhaftig.

If an insurer who made a contract of insurance on behalf of another without having a mandate to do so, did not inform the underwriter of such fact, the contract is invalid. If he did inform the underwriter thereof, the insured has the benefit of the contract at once.
