贈与中ニ存スル不能又ハ不法ノ条件ハ一般合意ノ規則ニ従ヒ其贈与ヲ無効トス
353. Any impossible or illegal conditions which exist in a testament are deemed as not mentioned.
Where they exist in a written donation, such donation is null and void.
